1. Acceptance of these Terms
By purchasing a product, activating 30-Day All Access, submitting a protocol request, downloading a document, or otherwise using MyClinicProtocols, you agree to these Terms & Conditions. If you are purchasing for a clinic, business, or organization, you represent that you are authorized to accept these Terms on its behalf.
2. Services provided
MyClinicProtocols prepares customizable clinical documentation resources for aesthetic, wellness, weight-management, and related healthcare practices. Depending on the product purchased, materials may include clinical protocols, SOPs, standing-order templates, consent forms, intake forms, treatment records, aftercare, safety documents, checklists, and related clinic documentation.
Products and services may be customized using information supplied by the customer, including clinic name, state, provider roles, products, medications, devices, techniques, and workflow.
3. Clinical responsibility and final approval
MyClinicProtocols documents are support materials for qualified professional review. They are not a substitute for patient-specific medical judgment, prescribing decisions, supervision, delegation, training, or approval required by law.
The purchasing clinic's appropriately qualified medical director, supervising provider, prescriber, or other authorized clinician is responsible for reviewing, approving, modifying when necessary, and implementing all clinical materials before use.
MyClinicProtocols does not create a physician-patient relationship, medical-director relationship, supervisory relationship, prescriptive authority, delegation authority, or professional scope of practice.
4. Legal, regulatory, and scope-of-practice limitations
MyClinicProtocols does not provide legal advice and does not guarantee that a document is legally compliant merely because it references a state, profession, medication, device, or procedure. Laws, board guidance, prescribing requirements, ownership rules, supervision requirements, delegation rules, and scope-of-practice rules vary by jurisdiction and may change.
The clinic is responsible for confirming current requirements with its qualified legal, regulatory, medical-director, or professional advisors before implementation. MyClinicProtocols may flag items for manual review, decline a request, or require additional information when the applicable authority is unclear or the requested service is outside the supported scope.
5. Customer responsibilities
You agree to provide complete and accurate information and to review all delivered documents before use. You are responsible for verifying the clinic's actual provider licenses, scope, ownership structure, medical-director arrangements, supervision, products, devices, medications, techniques, and workflow.
You may not rely on a document to authorize conduct that is not otherwise permitted by applicable law, professional licensing rules, product labeling, device instructions, or the clinic's governing policies.
6. Pricing and payment
Prices are displayed at checkout and may change for future purchases. Payment must be successfully verified before an order is confirmed or an All Access code is activated. Customized protocol packages are prepared after payment and delivered separately by email with a private download link. Payment processing may be provided by a third-party processor. MyClinicProtocols does not store full payment-card credentials.
Customers are responsible for taxes, bank charges, currency-conversion fees, or payment-processor fees that may apply to their transaction unless otherwise stated.
7. Delivery, turnaround, and revisions
After payment is verified, the customer receives an order confirmation and MyClinicProtocols begins preparing the customized package from the applicable master protocol materials. Completed Word and PDF files are delivered by email with a private download link.
Most orders are completed within 1-2 hours and may take up to 24 hours depending on request volume, complexity, number of treatments, state-specific review needs, missing information, specialty requests, or technical issues. Delivery times shown on the website are estimates, not guarantees.
Where a purchase includes revision rounds, revision requests must be submitted within the stated revision window and must relate to the originally purchased treatment or document set. Major scope changes, added treatments, new jurisdictions, or requests outside the original order may require a new purchase.
8. 30-Day All Access
30-Day All Access is a one-time access pass for one clinic or legal practice. It is not automatically renewing unless a future checkout specifically states otherwise.
- The 30-day period begins after payment is verified and the access code is activated.
- The access code is personal to the purchasing clinic and may not be shared, transferred, sold, sublicensed, or used by another clinic or legal practice.
- There is no stated numerical cap on eligible protocol requests submitted during the active 30-day period.
- Requests must be genuine clinic requests and must be submitted before the access period expires.
- MyClinicProtocols may reject duplicate, automated, abusive, resale-oriented, fraudulent, incomplete, unsupported, investigational, unlawful, or out-of-scope requests.
- Turnaround may vary when many requests are submitted at once.
- Requests submitted after expiration require a new purchase or renewed access.
9. Refunds and cancellations
Because MyClinicProtocols provides digital and customized services and may begin work shortly after payment, refund eligibility is limited after work has started, an access code has been activated, or digital files have been delivered. Refunds may be provided for duplicate charges, verified technical payment errors, or when MyClinicProtocols determines that it cannot provide the purchased service. Any refund rights required by applicable law remain unaffected.
To request review of a charge, contact MyClinicProtocols promptly at myclinicprotocols@gmail.com with the order reference and reason for the request.
10. Intellectual property and document license
MyClinicProtocols retains ownership of its underlying templates, systems, layouts, proprietary wording, structure, website content, and other intellectual property. After payment, the purchasing clinic receives a limited, non-exclusive license to use, edit, print, and internally distribute the delivered documents for that clinic's own operations.
You may not resell, republish, sublicense, distribute, upload for public access, provide to unrelated clinics, or commercially exploit MyClinicProtocols templates or deliverables as a competing document product or service.
Customer-provided logos, names, branding, and clinic-specific information remain the customer's property.
11. Patient information and PHI
Do not submit patient names, dates of birth, medical-record numbers, photographs, protected health information, or other patient-identifying information through MyClinicProtocols order or request forms unless MyClinicProtocols has expressly provided a workflow designed and authorized for that information.
Customers are responsible for removing patient identifiers before submitting supporting materials. MyClinicProtocols may delete, reject, or decline to process information that appears to contain unnecessary patient-identifying data.
12. No warranty of clinical outcome or universal compliance
To the maximum extent permitted by law, MyClinicProtocols services and documents are provided for professional review and use without a guarantee of a particular clinical, legal, financial, regulatory, operational, or business outcome. No document can account for every clinic-specific fact or every future change in law, guidance, product labeling, or professional standards.
13. Limitation of liability
To the maximum extent permitted by applicable law, MyClinicProtocols will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use or misuse of its documents or services, including lost revenue, business interruption, regulatory action, patient claims, or reliance on outdated or inaccurate customer-supplied information.
To the maximum extent permitted by law, MyClinicProtocols' aggregate liability relating to a specific purchase will not exceed the amount actually paid to MyClinicProtocols for that purchase.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless MyClinicProtocols and its owners, personnel, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from your clinic's implementation, modification, misuse, unauthorized distribution, unlawful use, clinical decisions, regulatory noncompliance, or breach of these Terms.
15. Suspension or termination
MyClinicProtocols may suspend or terminate access, reject requests, or disable an access code when there is suspected fraud, payment reversal, code sharing, resale, abuse, unlawful activity, repeated violation of these Terms, or misuse of the service. Suspension does not create a right to extend an access period unless MyClinicProtocols chooses to do so.
16. Third-party services
The website may rely on third-party services for payment processing, hosting, email delivery, analytics, storage, or other functions. Those providers may have their own terms and privacy practices. MyClinicProtocols is not responsible for outages or failures caused solely by third-party providers beyond its reasonable control.
17. Changes to these Terms
MyClinicProtocols may update these Terms as the service changes. The version in effect when an order is placed governs that purchase unless a change is required by law or is expressly accepted later by the customer.
18. Severability and non-waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law. Failure to enforce a provision once does not waive the right to enforce it later.
19. Contact
Questions about these Terms, billing, or service use may be sent to myclinicprotocols@gmail.com.
These Terms are designed as a practical business-protection framework. Because enforceability can depend on the legal entity, customer location, and governing jurisdiction, MyClinicProtocols should have qualified counsel review the final Terms, especially the refund, indemnification, limitation-of-liability, dispute-resolution, and governing-law provisions.
